Terms and Conditions

Thank you for booking a photography session with White Orchard Photography (“the photographer” or “I”). These Terms and Conditions ("T&Cs") govern you (“the client” or “you”) booking of photography services, including photo shoots, sessions, and sittings. Please take a moment to carefully read through these terms, as they will apply to your booking.

If you have any questions or concerns about these T&Cs, feel free to reach out at any time. By proceeding with your booking, you acknowledge that you accept and agree to these terms.

I reserve the right to modify these Terms & Conditions at any time. Should any changes occur, I will provide reasonable notice to you.

Once your deposit has been received, it will be understood that you have read, understood, and agreed to these Terms and Conditions in full.

 

Acceptance

By booking and/or paying your session fee, you confirm your acceptance of these Terms and Conditions, creating a legally binding contract unless you explicitly object in writing before confirming your booking. No amendments to this contract will be recognised unless agreed upon in writing.

 

Reservations

Your photography session will be confirmed only once your session fee has been paid. The session fee must be received within 24 hours of your booking, or your session will be cancelled. Please note that the session fee is non-refundable, as it covers the photographer’s time spent planning and preparing for your photoshoot.

 

Rescheduling, Refunds & Cancellations

If White Orchard Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid.

If you are unable to attend your scheduled session, I am happy to reschedule once within a three-month period. If the client cancels with at least 7 days in advance. Failure to contact me or show up for your session will result in no refund. For cancellations made 7 days or less before the scheduled session, the photographer is under no obligation of rescheduling.

Rescheduling is subject to the photographer's availability, and while I will make every reasonable effort to accommodate you, please note that during busy periods, such as the lead-up to Christmas, an alternative date may not be possible until the following year.

If we cannot agree on a new date, or if you are unable to attend the rescheduled session, your session fee will be forfeited. Additionally, your session fee is non-refundable if you cancel your photoshoot.

Please also be aware that all Gift Vouchers and are non-refundable and must be used by the date specified on the voucher.

Session fees made for any photography services, including photography sessions are strictly non refundable and non transferrable

 

Copyright

Under the Copyright, Designs and Patents Act 1988, the photographer retains the copyright of all images. It is a breach of this Act to copy, publish, reproduce, or store images electronically without obtaining explicit permission from White Orchard Photography. Should permission be granted, copyright transfer will only occur once full payment for the copyright is received.

The client may not alter, modify, or manipulate any image—whether by computer editing or any other technique—or reproduce the image in whole or part as part of another image, montage, or creation, either personally or through a third party.

 

Lateness

Time is valuable, and as a photographer with a busy schedule, I allocate specific time slots for each client to ensure I have sufficient time to capture your photos. Arriving late impacts this, and I will not be able to extend your session due to lateness, regardless of the circumstances.

If you arrive more than 20 minutes late without prior notification, your session will be automatically cancelled, and no refund will be issued. Deposits lost due to lateness cannot be transferred to another appointment date.

 

Health

If you are unwell with an infectious disease, please notify me as soon as possible and reschedule your session until you are fully recovered and no longer contagious. This policy is in place to protect the health and safety of all clients, including vulnerable newborn babies.

I have a strict 96 hours minimum, free of any health issue before entering the studio, including but not limited to: coughs, colds, flu, sickness & diarrhoea etc

Additionally, when booking, please inform me if you or anyone attending the session has any health conditions, such as allergies, photosensitive epilepsy, medical issues, physical difficulties, or disabilities, so we can make appropriate accommodations.

 

Editing

While I strive to produce beautiful and polished images, certain elements may not always be possible to remove or modify through editing, including but not limited to:

  • Wispy hair

  • Snot

  • Sleep crusts

  • Food crumbs

  • Dribble

  • Wrinkled or bobbled clothing

  • Chipped nail polish

  • Grey hairs

  • Fluff or lint

 

To ensure the best results, I recommend addressing these details before the session. Please be proactive during the photoshoot by using wipes to clean children’s faces and be prepared to embrace the natural, unedited moments. It’s helpful to bring a lint roller to eliminate fluff and a muslin square or extra bib for wiping away any baby dribbles.

Please ensure that everything is to your liking before we start the shoot, as there will be limited editing available after the session.

 

Sales

Product specifications are provided in the product description before purchase and may be updated periodically. The company reserves the right to modify the specifications of any product without prior notice.

For bespoke or personalised items, the client will receive a proof for approval before production. Products will only be ordered once the client confirms their satisfaction with the proof.

It is the client's responsibility to thoroughly review the proofs for any errors that may have occurred during the design process and request corrections if necessary. White Orchard Photography cannot be held accountable for any mistakes that are not identified by the client prior to the product going into production.

 

Backup

It is the client’s responsibility to ensure that digital photographs are securely backed up after delivery (e.g., on a personal computer or external hard drive). White Orchard Photography cannot guarantee the availability of images beyond 3 months, as your gallery will expire after this period. In the event of loss or damage to the images, no replacements will be provided once the gallery has expired.

 

Product Delivery

Bespoke products, other than digital files, typically take around 4 weeks to create, starting from the point when the client approves the order. Digital files will be available for viewing within 14-21 days following the photoshoot, allowing time for post-production and editing.

Prints and additional products must be collected from the studio by the client. If delivery is requested, an additional charge will apply.

Creative Licence

White Orchard Photography is granted creative and artistic licence regarding the selection of locations, poses, editing images and photographic style. The photographer’s judgement on these matters, as well as the number of photographs taken, will be considered final.

Please note that some photos may not be feasible due to weather conditions or the availability and cooperation of subjects. While every effort will be made to accommodate specific requests, White Orchard Photography cannot guarantee the capture of any particular image, background, location, or group arrangement.

 

IMAGE PERMISSIONS RELEASE

Sharing the photographs I create is an essential part of running my photography business – showcasing my work is often one of the main reasons clients choose to book with me! I also love sharing your stories and images on my blog, giving you a personalised page to share with friends and family, especially those who may be far away. For privacy, I do not include surnames or specific address details.

However, as required by the General Data Protection Regulation (GDPR), I must be clear about how your images may be used and obtain your consent. To ensure full transparency, I will ask you to sign an agreement regarding the use of your images, which will be linked to your contract.
